Do You Know Your Arizona Sign Rights?
Many Arizona homeowners reside in a neighborhood with a home owners association, but you'd be surprised how few residents know what HOA practices are allowed and not allowed. So here's a quiz question for you:
My home owners association can regulate aspects of my property except for one:
A.) Exterior paint color
B.) Fence height
C.) Real estate sign color
D.) All of the above
If you chose “C”, then you'd be correct. In fact, according to the bill signed into law by Governor Brewer back in 2010, home owner associations cannot restrict law approved real estate signs in your yard. In Arizona, HOA's are prohibited from regulating or restricting the use of “for sale,” “for rent,” or “for lease” signs on a property owner's yard as long as the sign meets statutory requirements and the HOA does not prohibit or restrict leasing. Phoenix property management companies advise property owners to be aware of their sign rights should they have a conflict with their HOA.
If you're currently having a dispute with your HOA regarding the color, size, or placement of your “for sale,” “for rent,” “for lease,” or even “open house” signs then Phoenix property managers recommend standing up for your rights. As long as your signs meet the necessary requirement of the law, they are in fact allowed. Those requirement are that the sign must be commercially produced, cannot exceed eighteen by twenty-four inches, and the rider attached cannot exceed six by twenty-four inches.
Some HOA communities may try to charge a homeowner for the use or placement of their “for sale” signs; however the legislature on these practices is very clear. The bill also prohibits HOAs and condo communities from charging a fee for the use or placement of these real estate signs by a property owner.
